SAN ANGELO, Texas (Concho Valley Homepage) — A San Angelo man charged with trafficking a child and engaging in sexual conduct with them has received 5 years of probation after pleading guilty to the charge.

According to court documentation, Andre Miguel Fay has pled guilty to a charge filed of trafficking a child and engaging in sexual conduct. Filed on April 26, 2023, the charge is a first-degree felony that could see those convicted of it confined in the Texas Department of Criminal Justice for 5 to 99 years.

In exchange for pleading guilty to trafficking a child, Fay has been sentenced to 5 years of probation and a $1,000 fine. Documents also indicate that the probation was received as "deferred adjudication."

According to the Brazos County government website, "deferred adjudication means that the finding of guilt is deferred or put off by the judge, even though there is enough evidence to have found the offender guilty of the offense." Should a judge determine that there is enough evidence to find the offender guilty and choose to defer the finding of guilt, "a sentence of community supervision is imposed with terms and conditions of supervision as with convicted offenders."

According to a complaint document, a Texas Ranger was contacted on April 28, 2023, by a Texas Department of Public Safety special agent who needed assistance with an investigation into a possible assault of a female child. The agent told the Ranger that Fay was seen accompanying a 15-year-old runaway female juvenile at San Angelo Lodge.

Fay would be detained by law enforcement for harboring a runaway, and the juvenile was taken to the Child Advocacy Center in San Angelo. During a later interview, the child made an outcry to having sexual intercourse approximately three times with Fay at his residence, which was later determined to be an apartment located at the College Hills West Apartments complex.

Andre would later confess to multiple things, including touching the child's "buttocks and leg" and "kissing her on the lips on at least two occasions." Andre claimed during an interview that the child "told him she was 17."

Another interview conducted with the victim revealed that Fay had rubbed "his erect penis on her buttocks" on more than one occasion during her time with him.
